PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE OUR SITES.

SIN-MIN, LLC dba SIN-MIN (collectively, “Company,” “we,” “us,” or “our”) welcomes you to our digital home. This Terms of Service Agreement (the “Agreement”) is a legal agreement between you and us governing your use of our websites, online storefront, and mobile services (collectively the "Sites").

IMPORTANT NOTICE: This Agreement contains a mandatory arbitration provision and a class action waiver. Please review the "Disputes, Arbitration and Class Action Waiver" section below, as it requires you to resolve disputes with us on an individual basis through final and binding arbitration.

1. Our Intellectual Property Rights

All names, logos, text, designs, graphics, trade dress, characters, interfaces, code, software, images, sounds, videos, photographs, and other content appearing in or on the Sites (the “Content”) are protected intellectual property of, or used with permission or under license by, our Company. You do not acquire any right, title, or interest in any Content by accessing or using the Sites. We grant you a limited, non-commercial license to access and use the Sites for personal, informational, and shopping purposes only.

2. Your Authorized Use of Our Sites

While using the Sites, you are required to comply with all applicable laws. You may not use the Sites for any fraudulent or unlawful purpose. You agree not to:

 

• Post or transmit any content that is unlawful, harmful, harassing, defamatory, vulgar, or infringing on intellectual property.

   

• Impersonate any person or entity.

• Disseminate viruses, worms, spyware, or malicious code.

• Use data mining, bots, spiders, or automated tools to scrape or extract data from our Sites.

• Attempt to bypass security protections or attack our Sites.

3. SMS, Email, & Mobile Messaging (TCPA Compliance)

If you elect to receive marketing text messages or emails from us (e.g., via platforms like Klaviyo), you consent to receive recurring promotional and personalized marketing messages (e.g., cart reminders) at the mobile number or email address provided.

• Consent is not a condition of any purchase.

• Message and data rates may apply. Message frequency varies.

• You can unsubscribe from text messages at any time by replying STOP, or from emails by clicking the "Unsubscribe" link at the bottom of the email.

4. Descriptions, Orders, & Shipping

We reserve the right to change the goods and services offered, prices, ingredients, specifications, and promotional offers at any time without notice. We do not warrant that product descriptions, colors, or photographs are entirely accurate or error-free. We reserve the right to limit quantities, cancel orders, or refuse service at our sole discretion (including accepted orders due to pricing errors or inventory shortages). All orders are subject to our Returns & Exchanges Policy.

5. Third-Party Content and Links

Our Sites may provide links to third-party websites or social media pages (e.g., Instagram, Facebook) for your convenience. We do not endorse or sponsor these external sites, nor are we liable for their content, accessibility, or security. Your use of third-party websites is at your own risk.

6. Disclaimer of Medical Advice

THE CONTENT ON OUR SITES MAY CONTAIN INFORMATION ABOUT NATURAL INGREDIENTS, PROCESSES, AND THERAPIES THAT ARE NOT EVALUATED BY THE FOOD AND DRUG ADMINISTRATION (FDA).

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DOWNLOADING OR OBTAINING CONTENT THROUGH THE SITES IS AT YOUR OWN RISK.

8. Limitation of Liability

WE AND OUR AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SITES, INCLUDING LOSS OF DATA OR PROFITS. IF WE ARE FOUND LIABLE, OUR MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF THE ACTUAL AMOUNT PAID BY YOU TO US OR $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE PROVISIONS MAY NOT APPLY TO YOU.

9. Indemnity

You agree to indemnify, defend, and hold harmless SIN-MIN, LLC and its officers, employees, and agents from any claims, damages, losses, or costs (including reasonable attorneys’ fees) arising directly or indirectly from your breach of this Agreement, your use of the Sites, or any User Content you submit.

10. Disputes, Arbitration, and Class Action Waiver

PLEASE READ CAREFULLY. You and we agree that any dispute or claim arising out of or relating to this Agreement, the Sites, or our Privacy Policy shall be determined by binding arbitration or in small claims court, governed by the laws of the State of California.

• Pre-Arbitration Notice: You must first send a written "Notice of Claim" by certified mail to: General Counsel, SIN-MIN, LLC, 4517 Market St, Ste 8, Ventura, CA 93003. We will attempt to resolve the claim within 30 days.

• Arbitration Rules: If unresolved, arbitration shall be administered by JAMS under its Streamlined Arbitration Rules.

• Class Action Waiver: YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. Copyright Infringement Notices
